TEIGNBRIDGE District Council (TDC) has confirmed it is seeking independent legal advice to determine whether Vistry Homes restarting works at Wolborough Barton would breach planning control.

In April 2025, the council issued a temporary stop notice to restrict building work at the Wolborough Barton site, more commonly referred to as NA3.

And although the notice expired on June 24, the developer, Vistry Devon South West, agreed not to restart work while legal matters were being considered.

Since then, only agreed safety and environmental mitigation measures have taken place on-site.

Having sort legal advice, however, Vistry Homes have since informed TDC of its intention to restart some infrastructure work in areas outside the Wolborough Fen SSSI hydrological catchment.

‘They have stated that this is necessary due to seasonal weather pressures, the need to keep the project moving, and to protect housing delivery and funding commitments’, a spokesperson for TDC said.

The council has confirmed it is seeking independent legal advice to determine whether restarting these works would breach planning control.

The TDC spokesperson went on to say that: ‘the developer has been advised that any work carried out before this advice is received is entirely at their own risk.

‘If considered necessary and reasonable, the council will consider taking appropriate enforcement action following receipt of the independent legal advice’.
